Shorter form mediation

Often many hours of patient work by the mediator and the parties are needed to achieve a resolution of the dispute at the mediation meeting. This is why the normal approach is to set aside a full working day. But this will not be suitable in every case and there is an alternative which we have called ‘time limited mediations for smaller disputes’, but is also known as ‘shorter form mediation’.

The idea behind time limited mediations for smaller disputes is for the parties and the mediator to agree that the mediation meeting will take no longer than a fixed period; three or four hours is what is usually agreed. It is likely to be suitable if the cost of a mediation is a real concern. The limited time at the meeting also ensures that everyone remains focussed on their objectives and uses the allotted time effectively.

The mediator will expect the parties to provide a position statement, or answer a detailed questionnaire, and provide the core papers in advance. The mediator will spend some time with each party before the mediation day either on the phone or in a remote meeting to understand their objectives. This will enable the mediation day to make a speedy start when the meeting starts.
